Whacky Games

These Terms of Use govern your access to and use of mobile games and related services provided by Whacky Games. By downloading, accessing, or playing our games, you agree to these Terms.
If you do not agree to these Terms, do not use the game.

Eligibility

Our games are intended for players of all ages. If you are under the age of 18, you should review these Terms with a parent or guardian.
Parents or guardians are responsible for supervising a child’s use of the game, including any purchases made through platform provided systems.

License to Use

Whacky Games grants you a limited, non exclusive, non transferable, revocable license to access and play the game for personal, non commercial use, subject to these Terms.

Accounts

Creating an account is optional and not required to play. Accounts may be created using platform provided sign in services from Apple or Google. Players may also choose to voluntarily link an email address to their account.
You are responsible for maintaining the security of your account and for all activity that occurs under your account.

Prohibited Conduct

You agree that you will not:
• Attempt to hack, reverse engineer, decompile, or modify the game or its systems
• Use cheats, bots, automation, exploits, or unauthorized third party software
• Circumvent security features or access restricted areas of the game
• Interfere with servers, networks, or other players’ gameplay
• Exploit bugs or errors for unfair advantage
• Use the game for any illegal or unauthorized purpose
Whacky Games may suspend or terminate access for violations of these rules.

Virtual Items and Purchases

The game may include virtual items or optional in app purchases. Virtual items have no real world value and cannot be transferred, sold, or redeemed outside the game.
All purchases are processed through Apple App Store or Google Play and are subject to their respective payment terms and refund policies. Whacky Games does not process payments directly.

Intellectual Property

All content in the game, including software, artwork, graphics, music, characters, text, and trademarks, is owned by Whacky Games or its licensors, unless otherwise noted.
Some games, rules, mechanics, or concepts included in our games may be considered public domain. However, not all content within our games is public domain. Original artwork, designs, presentation, branding, and other creative elements may be owned by Whacky Games or licensed from third parties.
If you believe that you own the copyright to any content that appears in one of our games, or believe that content has been included in error, please contact us at privacy@whackygames.com with relevant details. We take these concerns seriously and will review them promptly.
Except as expressly permitted in these Terms, you may not copy, distribute, modify, sell, or create derivative works based on the game or its content without prior written permission from Whacky Games.

Fan Content and Fan Sites

Whacky Games welcomes fan created content. Yes, you can record gameplay, take screenshots, stream, post videos, write guides, create tutorials, and share game related content online.
Fan sites and community resources that help players understand the game, learn mechanics, or enjoy the experience are allowed and encouraged.
We are not here to force anyone into strict rules or shut down creativity. These guidelines exist to keep things accurate, fair, and positive for the community.
To keep things simple, fan content must follow these basic rules:
• The content should be non commercial in nature
• The content should reflect the game as it actually exists
• The purpose should be to help, educate, or entertain players
• The content should not promote cheating, exploits, or harmful behavior
• The content should be respectful and appropriate for a general audience
• The content must not imply official endorsement or ownership by Whacky Games
• Use of Whacky Games names, logos, or assets should be limited to identifying the game or showing real gameplay
Whacky Games may request changes or removal of content that violates these guidelines or misrepresents the game.
This permission does not transfer ownership of any Whacky Games intellectual property and may be revoked if the content no longer follows these Terms.

User Content

If the game allows you to submit content, you grant Whacky Games a non exclusive, royalty free license to use, display, reproduce, and distribute that content in connection with the game.
You agree not to submit content that is unlawful, harmful, abusive, offensive, or that infringes on the rights of others.

Service Availability

Whacky Games may update, modify, suspend, or discontinue the game or any part of it at any time. We do not guarantee that the game will always be available or free of errors.
Progress, virtual items, or features may change as part of updates or balance adjustments.

Termination

Whacky Games may suspend or terminate your access to the game if you violate these Terms or misuse the service.
Upon termination, your license to use the game ends immediately.

Disclaimer of Warranties

The game is provided on an “as is” and “as available” basis. Whacky Games makes no warranties regarding performance, availability, accuracy, or error free operation.

Limitation of Liability

To the fullest extent permitted by law, Whacky Games will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the game, even if advised of the possibility of such damages.

Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

Changes to These Terms

Whacky Games may update these Terms from time to time. Continued use of the game after changes are posted means you accept the updated Terms.
